ARTICLE 1: FIELD OF APPLICATION / ACCEPTANCE

These general conditions of sale establish the contractual relations between Csaba Noard Molnar (MocsArt), registered with the Luxembourg Trade and Companies Register under number A40840, whose registered office is at 30 rue Demy Schlechter L-2521 Luxembourg, hereinafter referred to as "MocsArt", and its Clients.

Any order made by a Customer on the site mocsart.lu automatically entails adherence to these general conditions of sale. The contract of sale is subject to the Luxembourg legislation.

MocsArt reserves the right to modify some of the provisions of its general conditions of sale on an ad hoc basis, so that it is necessary to read them before each visit or purchase on the mocsart.lu website. The general conditions of sale applicable are those in force at the date of placing the order. Before validating an order, the Customer declares that he has been able to access the general conditions of sale from the site mocsart.lu, to have read them, to have understood the terms and to accept them without limitations or reserves.

The present general conditions of sale apply during all the period of placing on line of the articles presented on mocsart.lu

These general conditions of sale are subject to Luxembourg law, in case of litigation, jurisdiction is attributed to the courts of the Grand Duchy of Luxembourg.

The Customer agrees that all communications and invoices will be sent electronically.

ARTICLE 2: PRODUCTS

All products offered for sale are described with the greatest possible accuracy. However, should errors or omissions occur in this presentation, MocsArt's liability can not be incurred. The photographs, the illustrations and the texts of the site are merely indicative and have no contractual value.

The oil descriptions on our website are NOT intended to replace a one-on-one relationship with a qualified health care professional and are not intended as medical advice. 

Product offers are valid, within the limit of available stocks, as long as they are visible on mocsart.lu on the day of the consultation by the Client.

ARTICLE 3: PRICES

Prices are quoted in Euros. The Value Added Tax (VAT) is not applicable for the products offered on the mocsart.lu website.

MocsArt reserves the right to modify its prices at any time knowing that the prices displayed on mocsart.lu on the day of the order will be the only applicable to the Customer.

ARTICLE 4: PASS ORDER

The Customer selects the desired items by clicking on the "add to cart" button. It is asked to choose the options, such as closures and / or colors, and indicate the desired quantity. Then the Customer validates by clicking on the button «add to cart» to put the desired articles in the basket.

In the event that the Customer has a delivery code provided by MocsArt, he must enter this code in the box provided and click on the "apply" button.

If the Customer wishes to validate his purchases, he clicks on the "Order" button. At any time during the ordering process the Customer has the possibility to modify the entered data, to remove or to add articles to the order before continuing with the button "Confirm the order".

ARTICLE 5: IDENTIFICATION

At the time of its first order, the Customer must register on mocsart.lu. To register, the Customer agrees to provide the contact details necessary to process his order, so he can create a customer account. (See Article 8: personal data)

During each visit, when placing an order, the Customer will have been identified beforehand by his username and password, it being specified that this is not used to make payment.

By creating a customer account on our MocsArt website, the Customer has the following advantages:

  • place orders faster
  • it can register, change its contact details and its delivery address
  • it can consult and follow your orders
  • it has the possibility to subscribe or unsubscribe to the Newsletter (opt-in system)
  • and many additional benefits

The Customer may nevertheless decide to settle as a guest without having a customer account.

ARTICLE 6: DELIVERY, TERMS AND FEES

6.1 Place of Delivery

The delivery is made to the address indicated for this purpose by the Customer when passing his order which includes destinations Luxembourg.

The delivery address must be a physical address (name, number, street, postal code, town, country).

If the customer wishes to send a package to an unlisted country, the customer must contact MocsArt on info@mocsart.lu, MocsArt will be happy to find a satisfactory solution for the customer.

MocsArt reserves the right to refuse any delivery to a PO Box.

In the event of an error in the name of the addressee, MocsArt can not be held responsible for the impossibility of delivering the product. The cost of postage is inclusive of VAT. Any delays do not give the customer the right to claim damages.

6.1.1 Removal of Package (s) by Customer

MocsArt also gives at the time of the order the possibility to take the order directly to the headquarters of MocsArt, located at 30, rue Demy Schlechter L-2521 Luxembourg. When the Customer chooses this mode, there is no delivery charge. The Customer is invited to make an appointment via info@mocsart.lu or by phone at +352 621270713 and after making the payment.

6.2 Shipping Fees:

The delivery costs include a participation in the preparation and packaging costs and the postage costs.

Free delivery in Luxembourg city (Delivered personally by MocsArt)

The delivery charges for Luxembourg (Other than Luxembourg-City) amount to:

Post L (max 2KG): 7.5 euros

Post XL (max 10KG) follow-up and insurance included: 12 euros

Ability to pick up the customer's parcel (s) from the MocsArt headquarters see point 6.1.1 Customer's pick-up

6.3 Delivery Time:

The deadline for the preparation of your package is 1 working day and the package will be shipped after receipt of payment.

Orders are delivered within 2-3 working days and are guaranteed by the Luxembourg Post Office.

After you have sent your parcel, you will receive an e-mail with the mailing number and the link from the post office where you can follow your parcel to your destination.

In case of absence during the passage of the factor, it will leave a notice of passage with the nearest Post office so that you can withdraw your parcel there.

6.4 Delivery Terms

The Customer must examine the delivered items as soon as they arrive and inform MocsArt without delay in writing of the damages related to the transport or the discrepancies of the agreed article. Transport damage must be communicated directly to the carrier.

MocsArt shall not be liable for any delay in delivery due to your absence from the place of delivery, incorrect address, strikes, accidents or any other circumstances of force majeure.

6.5. Availability

In the event of temporary unavailability, MocsArt reserves an additional week for the processing of the order. In case of definitive unavailability of product after ordering, the customer will be informed by e-mail or telephone of the articles in break.

The buyer will then have a working week (excluding weekends and public holidays) to request the cancellation or exchange of his order by contacting our customer service: By e-mail to info@mocsart.lu.

After this time and if no request was found on his part, the order will then be sent with the available items and only these items will be invoiced.

ARTICLE 7: PAYMENT

"Confirm order"

The electronic signature being validated by this "click" procedure on the "Confirm Order" button, the command has the same value as a handwritten signature.

After validating the order, the customer will receive an email to the e-mail address that he will have indicated before with the summary of his order and which will be acknowledgment of receipt.

This acknowledgment of receipt includes all the elements constituting the contract entered into between MocsArt and the Client. The order form as well as the invoice are recorded in the register of MocsArt, themselves preserved on a reliable and durable support. The Customer accepts that they are considered as proof of the contractual relations between MocsArt and the Client.

The Client may choose from the following payment methods:

7.1. Credit card (via Paypal)

Payment of the full price is due upon order. Payment will be made by credit card (VISA or MASTERCARD) via PAYPAL's secure and accredited payment system

The order validated by the Customer will be considered effective only when the bank payment center concerned has given its agreement. In case of refusal of the said center, the order will be automatically canceled and the customer informed by e-mail.

Shipping will be made upon receipt of payment.

7.2. With a Paypal account

Payment of the full price is due upon order. Payment is made using a valid paypal account, more information about paypal accounts at www.paypal.com

The order validated by the Customer will be considered effective only when the bank payment center concerned has given its agreement. In case of refusal of the said center, the order will be automatically canceled and the customer informed by e-mail.

Shipping will be made upon receipt of payment.

7.3. Bank Transfer

Payment of the full price is due upon order.

7.4. Cash on delivery

Payment of the full price is due upon delivery.

7.5. Payment at collection

Payment of the full price is due upon collection.

Furthermore, MocsArt reserves the right to refuse any order from a Customer with whom there is a dispute.

ARTICLE 8: PERSONAL DATA

In accordance with the law of 2 August 2002, the Customer has the right to access, modify, correct and delete data concerning him. To exercise this right, the Client can send an email to info@mocsart.lu with his / her contact details (surname, first name, address). Moreover, MocsArt undertakes not to communicate, free of charge or with counterpart, the details of its Clients to a third party.

ARTICLE 9: RIGHT TO RETURN

Regarding MocsArt's "Money-Back" offer please refer to art. 10 of these General Conditions of Sale.

In accordance with the legal provisions in force, the Customer has a period of 14 days from receipt of his products to exercise his right of return to MocsArt without having to justify reasons or to pay a penalty. If the right of return is exercised within the aforementioned period, only the price of the product (s) purchased will be reimbursed (delivery charges will be deducted); The costs of return being the responsibility of the customer.

To return or exchange an item, the Customer must make a request by filling out the RETURN OF PRODUCT form on mocsart.lu.

Any request to return to MocsArt beyond 14 days for any reason whatsoever can not be accepted.

The articles are to be restored completely (packaging, accessories, instructions ...) and in their original state allowing them to re-market in new condition.

Returns must be made with a copy of the purchase invoice and the return number to the following address:

Provided that the items returned to us are intact, the refund will be made within a maximum of 30 days from the date of the client's request for return.

MocsArt will reimburse you the market value in cash or by bank transfer.

ARTICLE 10: SATISFIED OR REIMBURSED

MocsArt's "Money-Back" offer is to reimburse 100% of the purchase price for Cold Pressed Oil. Excluded from this offer are the other products sold on mocsart.lu

The customer has a period of 7 working days from the date of receipt to return to his expense the cold-pressed oils.

The Client will have the choice of asking either a credit to be made on a next purchase or a refund of the products (delivery charges to be deducted).

The products must be returned to the following address: Csaba Noard Molnar (MocsArt) - 30, rue Demy Schlechter, L-2521 Luxembourg and be accompanied by a copy of the purchase invoice and the return number.

The reimbursement will be made within a maximum period of 30 days from the day when the client has informed us of his request for return, except for the costs of returning the products which are the responsibility of the Customer.

Regarding the voucher on a future purchase; A discount code will be awarded to be claimed on the next online purchase at Nappilla.lu.

ARTICLE 11: INTELLECTUAL PROPERTY

The reproduction of all documents published on the site is only authorized for the exclusive purposes of information for a strictly personal and private use. Any reproduction or representation, in whole or in part, of the site, or any of its components, on any medium whatsoever, for other purposes, including commercial purposes, is expressly prohibited and subject to The competent courts.

ARTICLE 12: COOKIES
